Welcome to the DND Cheeses website (the “Site”), operated by Nechama Deutsch, Company Reg. No. 661242818, located at 27 Amos St., Jerusalem (the “Site Management” and/or the “Company”).
Any use of the Site constitutes agreement to these Terms of Use, including all terms and conditions contained herein.
These Terms of Use may change from time to time, and users should check the Terms of Use each time they visit the Site. Browsing and/or using the Site in any way constitutes agreement to the Terms of Use and a commitment to act in accordance with them. It is clarified that these Terms of Use constitute a legally binding agreement in every respect and are binding on the user for all uses of the Site.
A customer wishing to cancel an order is requested to contact the Site Management as soon as possible, by phone at 054-7412729 or by email at dndcheese@gmail.com, and to provide their name, phone number, and order number.
An order can be canceled as long as it has not yet been prepared, picked, packed, or sent for delivery or pickup. (The average preparation time from receipt of the order is approximately 6 hours.)
A cancellation request received after the order has already been prepared, packed, transferred to a supplier, sent for delivery, or made available for pickup will be reviewed according to the circumstances of the case, the type of products, and the applicable law.
Cancellation of an order will only take effect once the customer has received explicit confirmation from the Site Management that the cancellation has been received and approved.
The products sold on the Site are food products, some of which are refrigerated, perishable, or have a limited shelf life.
Subject to the provisions of the law, a food product in good condition cannot be returned after it has been delivered to the customer or made available for pickup, among other things due to storage conditions, maintaining the cold chain, food safety, and preserving product quality.
No refund will be given due to a change of mind by the customer, non-use of the product, an ordering mistake on the customer’s part, or a mismatch with personal preference, after the product has been delivered in good condition and in accordance with the order. This is subject to the provisions of the Consumer Protection Law.
This does not detract from the customer’s right to receive a credit in cases where it has been proven that a defective, damaged, missing, or different product than the one ordered was supplied. The credit will be given in replacement goods or as a refund, depending on the customer’s method of payment.
If a cancellation request is approved before preparation of the order has begun and before it has been sent for delivery, the amount paid for the order will be refunded to the customer, according to the payment method used for the transaction.
To the extent permitted by law, the Site Management may deduct a cancellation fee at the maximum rate and amount permitted by law.
No cancellation fee will be charged if the cancellation results from a defect in the product, a mismatch between the product ordered and the product supplied, failure to deliver the order on the agreed date, or another breach by the Site Management.
A customer who received a defective, damaged, missing, expired, or incorrect product is requested to contact the Site Management as soon as possible after receiving the order, and no later than 24 hours from the time of receipt.
When contacting us, please include, if possible:
The Site Management will review the request within a reasonable time and may ask the customer for additional details, photos, or information needed to investigate the matter.
If it is found that a defective, damaged, missing, or incorrect product was supplied, the Site Management will act, as applicable and depending on the circumstances, to replace the product, complete the missing item, provide a credit, or refund the amount paid for it, where possible, according to the customer’s payment method (cash, credit, or transfer).
The method of handling will be determined according to the type of product, stock availability, delivery date, and the circumstances of the case.
From the moment the order is handed over to the customer, or to another person on their behalf, responsibility for properly storing the products and transferring them to refrigeration lies with the customer.
The customer must store the products according to the instructions on the packaging and in accordance with the type of product, and in particular, must refrigerate chilled products without delay.
No refund or credit will be given for a product damaged due to improper storage, being left out of refrigeration, exposure to heat, unreasonable use, improper handling, or failure to follow storage instructions.
The customer is requested to check the order upon receipt and make sure that the products supplied match the order and that nothing is missing.
If possible, it is recommended to report any shortage or discrepancy to the courier or supplier as soon as it is discovered. If the problem is discovered after the order has been delivered, please contact the Site Management in accordance with the instructions above.
Signing for receipt of the order, where required, does not prevent the customer from later reporting a hidden defect that could not have been identified at the time of delivery.
It is the customer’s responsibility to provide correct, complete, and up-to-date contact details and delivery address when placing the order, and to be available to receive the order at the agreed time.
If the order cannot be delivered due to an incorrect address, no response, absence of the customer or their representative, refusal to accept the delivery, or any other reason attributable to the customer, the order will not be considered lawfully canceled.
In such a case, the Site Management may charge the customer for the cost of products already prepared, as well as for delivery, storage, or re-delivery costs, to the extent incurred and in accordance with the law.
Due to the nature of food products, re-delivery of products that were not received on the first attempt cannot be guaranteed.
A request to change an order, including adding or removing products, changing the quantity, changing the address, changing the delivery area, or changing the date, will only be possible after approval from the Site Management.
The Site Management does not guarantee that a change will be approved once processing of the order has begun. A change in the delivery area may result in changes to product prices, the minimum order amount, delivery costs, and the delivery date.
The Site Management may cancel an order, in whole or in part, in the event of a stock shortage, technical malfunction, an error in price or product details, a delivery issue, force majeure, suspected misuse of the Site, or other circumstances that prevent the order from being fulfilled.
In the event of a product shortage, the Site Management may contact the customer and offer an alternative product, a change in quantity, a credit, or a refund. An alternative product will only be supplied after receiving the customer’s consent, if the alternative differs substantially from the product originally ordered.
If the Site Management has canceled a product or order that was paid for in advance, the amount paid for the canceled product or order will be refunded to the customer. Other than the refund of the amount paid, the customer will have no claim regarding a cancellation resulting from reasonable circumstances beyond the Site Management’s control, subject to the provisions of the law.
A refund, where the customer is entitled to one, will be made, where possible, using the same payment method used for the order.
In the case of payment by cash or bank transfer, the customer may be asked to provide the details required to process the refund.
The time it takes for the refund to actually appear also depends on the credit card company, the bank, the payment service provider, or the clearing entity, and is not solely within the Site Management’s control.
A refund for a specific product will be calculated based on the amount actually paid for that product, after any discounts, coupons, or benefits applied to the order.
This policy is subject to the provisions of the Consumer Protection Law, 5741-1981, the regulations enacted thereunder, and any other binding law.
In the event of any conflict between the provisions of this policy and a mandatory legal provision that cannot be waived, the legal provision will prevail.
Nothing in this policy detracts from any right granted to the customer by law.
